This Privacy Policy describes how TVB (USA), Inc. (“TVB”, “we”, “us”, or “our”) collect and treat the information provided by USER or Subscriber (“you”, “your” or “yourself”) or your computer, mobile device, consumer electronic device or other mechanism or devices when you install, download, access or use any of the following platforms (our “Platforms”):

This Privacy Policy is incorporated into and forms part of our Terms of Use.   This is a binding legal agreement.  If you do not agree to comply with this Privacy Policy, then you should not use our Platforms, and you should exist our Platforms immediately. We reserve our right to modify any part of this Privacy Policy at any time by posting the modified version on our Platforms.  Unless as stated below, all modifications shall automatically be effective upon posting on our Platforms and shall supersede any previous versions of this Privacy Policy.  You agree to review this Privacy Policy on our Platforms regularly to ensure that you are aware of any modifications. By continuing to access or use our Platforms after any amendments to this Privacy Policy, you are agreeing to this Privacy Policy as revised. You can tell if there have been changes to the Privacy Policy since your last use of the Service by checking the date at the top of the Privacy Policy.

  1. What Information Collected from You
  •   There are two types of information we collect from you when you use our Platforms. 1) Personally Identifiable Information (“PII”) – information that you provide that can identify you as a specific individual; 2) Non-personally Identifiable Information (“NPII”) – information that we collected passively or automatically about you but cannot be identified as you.
  •   Account Information: When you register as a member of our Platforms, as a “Registered Member” or “Member”, enter a promotion, or link your profile on a third-party site or platform with your registration account, you provide personal information including PII to allow us to establish your account and to communicate with you in connection with your use of our Platforms.  If you register using other third-party platform or social network, you agree for us to collect your profile information from that third-party platform. When you enter any competition, games or any of our marketing activities, you may be required to provide us with your personal information.  This information include your title, user name, first name, last name, gender, country, state and city of residence, date of birth, mailing address, phone number, email address, user-id, and password.
  •   Transaction Information: When you become our Member, you provide us with personal information including PII such as postal address, and telephone number. When you contact us by submitting a suggestion, complaint, question, request or any other matters through email correspondence, your information including PII such as email address, name and other information will be collected by us.
  •   Usage and Device Information: When you access or use our Platforms, your usage or activity and device information will be automatically collected.  These information are NPII including but not limited to your usage, the time/duration and the contents and pages visited, the Platforms used (access log), the content you view, your preferences, and how often you use our Platforms, advertising that you viewed or visited, device data, system and application software, your interaction with our Platforms and other online platforms such as your browser or device type, unique device identifier, IP address, domain names, operating system type and version, mobile app token, language setting, network type, internet service providers and device location. When you register as a Member, your PII information will be used to track and collect including but not limited to your usage, activity and device information.
  •   Third-Party Information:  We may collect your information from or through a third-party product, service, application, website, our business partners, consumer report agency, data companies, advertising providers or servers, social networks, and other public domains.  This information may include but not limited to information you provide in the public forums on other third-party, profile and activity Information from a third party or platform, usage data about the use of our platforms on a third-party platform, usage and advertising viewing data collected by third-party advertising providers.
  •   Cookies and Similar Technologies:  We and/or our business partners and/or other companies we work with such as advertising networks/providers use Cookies, web beacons, tags or similar technologies for collecting activity, tracking information and preference information from you.  This information may include but not limited to demographics, device type, IP addresses, browser type, statistics about platform usage, internet Service Provider, pages visited, location, date and time, number of clicks, and other related information. You can disable or refuse certain Cookies.  But if you do disable or refuse certain Cookies, some features of our Platforms may be difficult to operate or may not function at all.  By using our Platforms, you consent to the use of these Cookies.
  •   You warrant to: (a) provide us true, accurate, current and complete personal data about yourself; and (b) update the foregoing data from time to time.  We may suspend or terminate your account or Member status or refuse your access to our Platforms or any part thereof without notice or accepting any liability if we suspect that you have breached this provision.
  1. How We Collect and Use Your Information
  •   Process your Member registration, application, administration, continuation and termination of the use of our Platforms and/or Service, and enable the provision of our Service.
  •   Verify your identity.
  •   Collect, respond and follow up your calls, inquiries, requests, and comments.
  •   Facilitate communication between you and us, so that we can send you news about our Platforms, Content and/or Software such as features, content availability, technical notices, updates, security alert, etc.
  •   Allow you to participate in any special features, activities or games offered on our Platforms, where you can choose to do so.
  •   Enter you into sweepstakes, contests or promotions where requested.
  •   Enable us to provide you with better services, we use your information to conduct research for further development and improvement of our Platforms.
  •   To provide technical support, software updates, and product support as needed by you.
  •   Send you newsletters and information about products, services and promotions relating to us and/or our business partners.
  •   Send you service-related communications, including but not limited to announcements and administrative messages.
  •   Customize or personalize advertising, offers and content made available to you based on your preference, usage and visits of our Platforms or other platforms, and the performance of those advertising.
  •   Prevent fraud or potentially illegal activities (such as copyright infringement) when accessing and using our Platforms.
  •   Enforce any terms and conditions and policies of using our Platforms.
  •   Help us understand the usage, location, devices, demographics of our users, and how the services of our Platforms are being used so that TVB can continuously improve them.
  •   Perform statistical research and analysis either by us or by other third parties.
  •   Customer profiling, and perform statistical analysis of your behavior and interest in any service provided by us.
  •   To the extent permissible under applicable laws, direct marketing of our Platforms, notifying you of promotion, special offers or new products information.
  1. How We Share Your Information
  •   Your information may be shared within us, our employees, officers and among our affiliates, and used to help TVB better tailor our Platforms to you.
  •   Your information may be shared with any agents, suppliers, contractors, professional advisors, insurers, other network operators or third party service providers who provide administrative, telecommunications, computer and other services to us and/or the relevant service(s) in connection with our Platform, Content and/or Software.
  •   Your information may be shared with our service providers that perform business services on our behalf, such as payment processing company, marketing emailing company, and analytics provider.
  •   Your information may be shared with our business partners to perform business services such as content streaming and delivery services.
  • Our Platforms may include links to third-party websites, plug-ins, and applications. Clicking on those links or enabling those connections may allow those third parties to collect or share data about you. This Privacy Policy only addresses the use and disclosure of information by us through your interaction with our Platforms.  We do not control other third-party websites that may be accessible through links from our Platforms and are not responsible for their privacy statements or the information that you share to them through our Platforms.  When you leave our Platforms, you should read the privacy policy notice of every website you visit prior to sharing any personal information with them.
  •   Your information may be shared with our third party advertiser or ad networks.  These third party advertisers may use your information to understand your usage, visits of our Platforms and other platforms to better deliver targeted advertisements to you.  They may also use your information to measure the effectiveness of their advertisements. We do not have access to or control over Cookies and other technologies that they may use.  We are not responsible for the privacy practices of third-party advertisers.
  •   Your information may be shared with other third parties assisting us in detecting, investigating, preventing or otherwise addressing fraud, security, or technical issues.
  •   Your information may be shared with law enforcement agencies, courts, regulators and government authorities.
  • Your information may be shared with any actual or proposed assignee, transferee or successor of or to our rights if we decide to sell any relevant part of our business.
  • Your information may be shared with legal professionals in connection with the establishment of legal claims or defenses, to obtain legal advice, to exercise and defend our legal rights or to protect the life, body or property of any individual.  
  1. How We Protect Your Information
  •   We maintain procedural, technical and physical measures to help protect against misuse, unauthorized access and disclosure of the personal information you provide via our Platforms.  However, no transmission of data is guaranteed to be completely secure.  It may be possible for third parties not under our control to intercept or access unlawfully your information even if there is a special notice that a particular transmission is encrypted.  Therefore, any transmission of personal information to us is made at your own risk.  If you believe that your interaction with us is no longer secure, please notify us using the Contact Us details below.
  •   It is stated in the T&C that if you are under the age of 13, you are not permitted to register with us or provide your personal information to us.  If you are at least 13 and under 18 years of age you must review the Terms of Use and this Privacy Policy with a parent or legal guardian to ensure the parent or legal guardian acknowledges and agrees to the Terms of Use and this Privacy Policy.  Should your parent or legal guardian not acknowledge and agree to the Terms of Use or this Privacy Policy, you must immediately discontinue its use and exit our Platforms. We do not knowingly collect or store any personal information from children under the age of 13 or 18 (depending on different State requirements).  We encourage parents and guardians to spend time with their children online and to be fully familiar with the online services, applications or websites used by their children.  If a parent or guardian becomes aware that his or her child under 13 or 18 (depending on different State requirement) has provided us with information without his or her consent, please contact us, and we will delete such information from our files within a reasonable time.
  •   We will retain your information as long as we can to satisfy legal, tax, and our business requirements.  If you do not wish our retention and/or use of your personal information at any time after giving us the information, you may email us using the email address indicated under “Help” of our Platforms.  We shall cease to use your personal information and shall disable your access to the relevant services upon receipt of your email notification. Your personal information will be removed from our storage three (3) months after we receive your above email notification.
  •   Rights for California Residents: If you are a California resident, you may request us to provide you with the direct marketing third-parties, with which we have shared your personal information. To process such a request, you must either e-mail us using the email address indicated under “Help” of our Platforms, or mail us using the mailing address indicated under “Help” of our Platforms.  You must include your full legal name, address and the statement “Your California Privacy Rights” in your request.
  •   If you are a California resident, you may request to access, change or erase your personal data stored with us. To process such a request, you must either e-mail us using the email address indicated under “Help” of our Platforms, or mail us using the mailing address indicated under “Help” of our Platforms.  In your request, you must include your full legal name, address, the statement “Your California Privacy Rights” and the details of your request (i.e. access, change or erase), and you must attach/submit a copy of your government-issued ID for account verification purposes. You can expect it will at least take 30 days for us to verify and act on your request accordingly.
  •   If you are a California resident, you may opt-out from having us selling your user’s information to any third party.  The procedure for the above opt-out process is: For the website, you must click the “Do Not Sell My Personal Data” link at the bottom of the home page, and follow any instruction given on screen.
  1. Privacy Policy Amendment
  •   We reserve the right to amend its Privacy Policy at any time, and your use of our Platforms following the posting of such change to the Privacy Policy will constitute your acceptance of any such change.
